Situation:
The client found themselves in a dispute with a business partner – an electricity supplier – regarding a breach of contractual obligations. The partner refused to provide the agreed performance due to market conditions, even though the client had fulfilled all their obligations. The partner cited ambiguities in the contract, which were not substantiated. The situation led to financial losses for the client and disrupted the business relationship.
Client’s Request:
The client sought judicial protection of their rights and the assurance of electricity supply. They required comprehensive legal support and representation before arbitration and civil courts, as well as assistance during negotiations with the business partner.
Our Solution:
Through a thorough analysis of all documents, we disproved the counterparty’s arguments. By filing with both the arbitration and civil courts (requesting a preliminary injunction), we ensured that electricity had to be supplied to the client, even though the business partner had initially refused. We subsequently achieved an out-of-court settlement and a commercial agreement between the parties, taking into account all of the client’s claims.
Result:
We secured a favorable energy price for the client for the upcoming period. The legal costs incurred during the dispute were covered by the counterparty.
