Situation:
The client had a contract with a telecommunications service provider, which included access to an application through which mobile operator services—and also electronics—could be ordered. Unfortunately, the security of the application was breached, and two individuals committed criminal acts by placing several dozen orders for various electronic goods in the client’s name, totaling over CZK 1 million. The operator of the application demanded that the client pay for all of the orders placed.
Client’s Request:
The client’s goal was not to be held liable for the goods they had not ordered. On the contrary, they sought to have the damage caused covered by the perpetrators of the criminal act.
Our Solution:
We represented the client as an injured party in the criminal proceedings and took part in the investigative actions conducted by the Czech Police. At the same time, we maintained active communication with both the law enforcement authorities and the telecommunications service provider. Thanks to the active involvement of both the client and our law firm, the police succeeded in apprehending both perpetrators of the crime and, more importantly, confirmed that the client could not be held responsible for the breach of the application’s security. Unfortunately, the telecommunications provider remained passive throughout the investigation and claimed that it had suffered no damage that would justify participating in the criminal proceedings as an injured party.
Result:
We succeeded in clarifying the key facts and reaching an agreement between the parties, under which the telecommunications service provider decided not to pursue the recovery of the alleged damages from the client.
